Grammy-winning singer H.E.R. wants out of her contract with MBK Entertainment for its “significantly limited” terms.
According to the lawsuit filed in the Los Angeles County Superior Court on June 16, which was obtained by The Blast, H.E.R., born Gabriella Sarmiento Wilson, is suing the company for the rights to her music catalog. Court documents show she is suing for declaratory relief and violation of the business and professions code.
The “Damage” singer signed the “significantly limited” contract ten years ago when she was 14 years old, which she believes should have now expired. According to The Blast, Wilson claims she “has not been free to provide her recording services except as permitted or dictated by MBK” and that the label “has exclusively owned the right to exploit her name and likeness for her recordings.”
One major part of the suit alleges that Wilson’s manager and owner of MBK, Jeff Robinson, made record deals, touring and publishing agreements using his own lawyers and that they “did not have a written fee agreement or a conflict waiver signed by Wilson.”
According to the report, Wilson understood she was an “exclusive employee” of the label until the expiration date of May 2019.
She is asking the judge to agree that MBK violated California’s seven-year contract rule and that the agreement is “unenforceable.” Wilson is also requesting restitution and paid court fees.
